Landlord Tenant Law
The landlord tenant law discusses the following topics:
Creation of Tenancy, Rents and Rental Agreements
Tenancy is fixed through a rental agreement, which may be oral or
written. This is for a fixed period of time (usually a year) or on a
monthly or weekly basis. The rental agreement must describe the
property, indicate the rent, utter the rental period, date of starting
and rent due dates, late charges for rent, be dated and signed by all.
The rent to be paid is determined by both the landlord and tenant. Rent
is paid at the end of the month.
Security Deposits
The landlord tenant law states that a sum of money
paid as an advance to the landlord is a security deposit. This payment
is made to make up for failure of payment, fix damages and clean up
after the tenant leaves.
Discrimination
All persons are considered equal and allowed equivalent
accommodations, advantages, etc., despite their gender, race, color,
religious preferences, origin, age or disability.
Pets and Waterbeds
Landlords may not agree to let out to any tenant along with a pet except properly trained dogs of a disabled tenant.
Condition, Maintenance and Repairs
According to the landlord tenant law, the landlord has to keep his property in a condition fit to occupy.
Tenant's Privacy and the Landlord's Right to Enter
The landlord enter the tenant's building only for certain reasons,
during working hours and after the tenant has been given at least 24
hour advance notice of the landlord's wish to enter the premises.
Tenant Defaults and Termination of Tenancy
A tenancy usually ends with the end of the rental period, but it may also terminate ahead of time.
Evacuation Procedure
The ultimatum for the tenant who has defaulted rent or has not
vacated the premises at the end of the lease period, is to evacuate
him.
